MCA-EASY EXIT SCHEME

sunil jain

Whether a company incorporated after 01.04.2008 is eligible to file papers under the ,EASY EXIT SCHEME, 2011? In my view requiremnt foa defunct co is that it should be registered under the Companies Act and should not be carrying on any business on or after 01.04.2008. Hence a co registered after 01.04.2008 say in 2010 should also be eligible to file papaers under the scheme. Kindly give your view.

Companies Incorporated After April 1, 2008, Not Eligible for EASY EXIT SCHEME 2011, Clarifies MCA A participant in a discussion forum inquired whether a company incorporated after April 1, 2008, is eligible to file under the EASY EXIT SCHEME (EES), 2011. The participant believed that a company registered after this date, even if defunct, should be eligible. Another contributor clarified that any defunct company with active status on the Ministry of Corporate Affairs portal could apply under EES, 2011, to have its name stricken from the Register of Companies. However, the original participant faced issues uploading the form and was informed by MCA that companies incorporated after April 1, 2008, are not eligible. (AI Summary)
