Dear Sir ,

Please clear , a company has cleared the material for export under bond and exported the material within stipulated time period but inadvertantlly not submitted the export documents with the concerned excise  authority within six month  .

Please clear , company is liable for payment of excise duy with interest on the exported material or not , deptt demanding , please provide the notification , circular or any judgement to savee the same .

Failure to submit Proof of Export within the prescribed period generally makes exports under bond liable to excise duty and interest, but an exporter may immediately submit the belated PoE with an application to the bond-accepting authority to condone the delay; if the authority, in its discretion, condones the delay, duty and interest need not be paid. In normal course, the Proof of Export ( PoE ) has to submit within the stipulated time as prescribed, failure to do so, have to pay the duty along with interest.

 

But still, if you have received the PoE righ now ( after six months) then immediately submit to the bond accepting authority with an Request application to Condone the Deflay.

If the delay is condoned then you need not to pay the duty along with the interest.

End of the day, it is all depends on the satisfaction of the bond accepting authority.

In future, for such cases, you may approach for exention for submission of PoE beyond the stipulated time.
