The Board has re-examined the issue, allowing the benefit for up to 3% of shipments annually, provided exporters declare exigencies upfront. A procedure is outlined for availing this facility, ensuring genuine cases are processed without delay while preventing misuse. Pending cases will be finalized per these guidelines.
