Central Excise Update: Joint Commissioners Now Handle Cases Above Rs. 5 Lakh Due to Additional Commissioner Shortages.
The amendment to Circular No. 97/8/2007-ST addresses the power of adjudication of Central Excise Officers. Due to the absence of Additional Commissioners in many Commissionerates, delays in adjudicating cases within their monetary limits have occurred. The Board has decided to allow Joint Commissioners to adjudicate cases with monetary limits previously assigned to Additional Commissioners, specifically above Rs. 5 lakh but not exceeding Rs. 50 lakh. Jurisdictional Commissioners must redistribute pending cases among Joint and Additional Commissioners accordingly. Compliance with these changes, including case reallocation and issuance of necessary documents, must be completed within 15 days, with a report submitted by 15.04.2008.
