Issues: Whether, in a stay application, the applicant was entitled to waiver of pre-deposit of the penalty amount and stay of its recovery in view of the prima facie classification dispute concerning SIM cards imported through couriers.
Analysis: The applicant had already paid the duty demanded, and the dispute turned on whether SIM cards were classifiable as parts suitable for use with cellular telephones. The Tribunal recorded a prima facie view that the Commissioner's classification approach was not acceptable at that stage, and also noticed support for the view that a cellular phone cannot be used without the SIM card and that the card may, to that extent, constitute a part of the phone. On that basis, the penalty was considered not to warrant immediate deposit pending disposal of the appeal.
Conclusion: Waiver of deposit of the penalty amount was granted and recovery of the penalty was stayed.
