A plain storage rack or cupboard whose essential function is storage may fall within furniture, but the present goods had a more specific functional character as a storage and retrieval system. The Explanatory Notes to Chapter 94 did not extend furniture to every article with a storage function, and items performing a predetermined non-furniture function were excluded. Applying the principle that the more specific description prevails, the article was more appropriately treated as material handling equipment than as furniture. The argument on limitation was not examined.
Conclusion: The goods were not classifiable under Heading 94.03 and were classifiable under Heading 84.28; the classification adopted by the Commissioner was set aside.
Final Conclusion: The appeal succeeded on classification, with consequential relief following from the setting aside of the impugned order.
