Analysis: The classification dispute turned on the interaction between Chapter 38, which covers catalysts, and Chapter 28, which covers compounds of precious metals. A product falling within Chapter Heading 2843.90 would be classifiable there notwithstanding its use as a catalyst, but only if it was first shown to be a compound covered by the relevant chapter notes. The record showed that the lower authority had largely relied on an earlier order, without independently analysing the chapter notes, the HSN explanatory material, the test report, or the technical composition of the product. Conclusion: The classification order was not proper and could not be sustained. The matter was remanded for de novo consideration with directions to examine the technical materials, chapter notes, HSN scope, and expert evidence, and to afford the assessee an opportunity to respond.
