Issues: Whether the Tribunal, in exercise of Rule 41 of the Customs, Excise and Gold (Control) Appellate Tribunal (Procedure) Rules, 1982, could direct the Customs authorities to issue a detention certificate for the period claimed by the importer.
Analysis: The majority held that the earlier appellate order had already been fully complied with and that the present application did not arise out of any appealable decision under the Customs Act, 1962. It was reasoned that the grant or refusal of a detention certificate was not a statutory function exercised under the Customs Act, 1962, but was connected with port trust demurrage rules and, therefore, lay outside the Tribunal's appellate and ancillary jurisdiction. The majority further held that Rule 41 could not be used to enlarge the Tribunal's powers beyond the statute, and that the writ jurisdiction exercised by the High Courts under Article 226 of the Constitution of India could not be equated with the Tribunal's powers.
Conclusion: The Tribunal had no competence to direct issue of the detention certificate, and the application was not maintainable.
Dissenting Opinion: The Judicial Member held that the detention of the goods was for customs purposes, that the certificate was a consequence of allowing the appeal, and that Rule 41 enabled the Tribunal to secure the ends of justice by directing issue of a modified detention certificate for the period 22-8-1981 to 20-10-1981.
