Issues: (i) Whether whey protein (WPC or WPI), not a mixture of two or more WPC/WPI, with or without sweetener/flavour/digestive enzymes/cocoa, is classifiable under Heading 0404 of the First Schedule to the Customs Tariff Act, 1975 or elsewhere; (ii) Whether whey proteins comprising two or more WPC and/or WPI containing protein up to 80% (w/w), with or without sweetener/flavour/digestive enzymes/cocoa, are classifiable under Heading 0404 of the First Schedule to the Customs Tariff Act, 1975 or elsewhere; (iii) Whether whey proteins comprising two or more WPC and/or WPI containing protein more than 80% (w/w), with or without sweetener/flavour/digestive enzymes/cocoa, are classifiable under Heading 3502 of the First Schedule to the Customs Tariff Act, 1975 or elsewhere.
Issue (i): Whether single whey protein products (WPC or WPI), not mixtures of two or more WPC/WPI, are classifiable under Heading 0404 or another heading when containing sweetener/flavour/digestive enzymes/cocoa.
Analysis: Apply the General Rules of Interpretation and HSN Explanatory Notes. Heading 0404 covers whey (including concentrated/powder forms) and permits limited additives (e.g., stabilizers, sugars, anti-caking agents, small quantities of vitamins/antioxidants). The Explanatory Notes do not list flavours, cocoa or digestive enzymes as permissible additives for Heading 0404. Heading 2106 covers miscellaneous food preparations/food supplements and includes preparations based on concentrates or isolates with flavours, sweeteners or similar additives.
Conclusion: Single whey protein products (WPC or WPI), not mixtures of two or more WPC/WPI, are classifiable under Heading 0404 if they do not contain flavour/digestive enzymes/cocoa; if such flavour/digestive enzymes/cocoa are present, they are classifiable under Heading 2106.
Issue (ii): Whether whey proteins comprising two or more WPC and/or WPI containing protein up to 80% (w/w) are classifiable under Heading 0404 or another heading when containing sweetener/flavour/digestive enzymes/cocoa.
Analysis: HSN Explanatory Notes and Note 5 to Chapter 4 indicate that concentrates of two or more whey proteins containing 80% or less whey protein (dry matter) are classifiable in Heading 0404. Permissible additives under Chapter 4 are limited; flavours/cocoa/digestive enzymes are not specifically permitted under Heading 0404. Heading 2106 covers food preparations with such additives.
Conclusion: Mixtures of two or more WPC/WPI with protein up to 80% (w/w) are classifiable under Heading 0404 when not containing flavour/digestive enzymes/cocoa; if such flavour/digestive enzymes/cocoa are present, they are classifiable under Heading 2106.
Issue (iii): Whether whey proteins comprising two or more WPC and/or WPI containing protein more than 80% (w/w) are classifiable under Heading 3502 or another heading, irrespective of additives.
Analysis: HSN Explanatory Notes to Heading 3502 identify whey protein concentrates composed of two or more whey proteins with more than 80% whey protein (dry matter) as albumins/concentrates ordinarily in Heading 3502. However, the Authority examined the nature of the applicant's compositions and the additives present and considered the classification of food preparations under Chapter 21/Heading 2106 for compositions containing flavours/cocoa/digestive enzymes. The Authority concluded that compositions of such concentrated mixtures, given their formulation as food preparations and the presence or possible presence of flavours/cocoa/digestive enzymes, fall within Heading 2106 as food preparations.
Conclusion: Whey protein mixtures of two or more WPC/WPI containing protein more than 80% (w/w) are classifiable under Heading 2106 of the First Schedule to the Customs Tariff Act, 1975, as food preparations (i.e., not classified under Heading 3502 in the ruling).
Final Conclusion: The Authority rules that (i) single WPC/WPI not mixtures - Heading 0404 if free of flavour/digestive enzymes/cocoa, otherwise Heading 2106; (ii) mixtures of two or more WPC/WPI with protein up to 80% - Heading 0404 if free of flavour/digestive enzymes/cocoa, otherwise Heading 2106; (iii) mixtures of two or more WPC/WPI with protein more than 80% - Heading 2106 as food preparations.
Ratio Decidendi: For classification, apply the General Rules of Interpretation and HSN Explanatory Notes: (a) single WPC/WPI and mixtures up to 80% whey protein (dry matter) fall under Heading 0404 absent non-permissible additives; (b) presence of flavour, cocoa or digestive enzymes renders the composition a food preparation classified under Heading 2106; and (c) mixtures of two or more WPC/WPI having protein content above 80% (dry matter) are treated as food preparations under Heading 2106 in the facts of this ruling.
