Rejection of three transfer applications filed by the Appellant - the Respondent has pointed out that out of three applications which was pending in Court III, one has been reserved and the Application which was pending in Court VI has also been reserved today itself - HELD THAT:- There are no reason to entertain this Appeal. The Appeal is dismissed. Delay of 6 days in filing the appeal was explained as caused by winter vacation and was condoned. The appeal challenged the Order dated 01 December 2023 which rejected three transfer applications seeking transfer of three Section 7 applications pending in Court III; one related matter had been earlier pending in Court II but was transferred to Court VI of the Mumbai Bench. The adjudicating authority rejected the transfer applications without noting the transfer from Court II to Court VI. The Respondent pointed out that, of the three matters, one was reserved and the application pending in Court VI was reserved the same day. In light of those submissions the appellate tribunal found no reason to entertain the appeal and dismissed it, making clear that 'order passed in transfer applications shall have no bearing on the merits since while deciding transfer application merits of the case are not touched.'
