Issues: Whether an arbitrator should be appointed under Section 11 of the Arbitration and Conciliation Act, 1996 in respect of the disputes arising out of the agreements between the parties.
Analysis: The application was made for appointment of an arbitrator to decide disputes concerning the implementation of the agreements and the supplementary agreement. The Court found that a dispute had arisen between the parties requiring adjudication by arbitration and therefore accepted the request for appointment of a former Judge as the sole arbitrator.
Conclusion: The petition was allowed and an arbitrator was appointed to adjudicate the disputes between the parties.
