Issues: Whether bail should be granted in a case involving recovery of commercial quantity of Codeine Phosphate in view of the restrictions under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Analysis: The materials on record prima facie showed recovery of 100 bottles of Phensedyl Syrup containing Codeine Phosphate in commercial quantity from the possession of the petitioners. In view of the statutory restrictions governing bail under the NDPS Act, the Court found no basis to extend the discretionary relief of bail.
Conclusion: Bail was refused.
