Maintainability of section 9 application - HELD THAT:- The present appeal is dismissed - It is clarified that the impugned judgment and the dismissal of the present appeal will not be construed as an expression of opinion on whether the petition under Section 9 of the IBC is within time. The Supreme Court dismissed the appeal regarding an application under Section 60(5) of the Insolvency and Bankruptcy Code, 2016 filed by M/s Thaicom Public Company Limited. The dismissal does not indicate an opinion on the timeliness of the petition under Section 9 of the IBC. M/s. Raj Television Network Limited can apply for an additional written statement following an amendment allowed by the National Company Law Appellate Tribunal, Chennai Bench. Any pending applications are disposed of.
