Substantial compliance under exemption notification sustains relief where escrow deposit and procedural lapses do not defeat the scheme.

Substantial compliance with an exemption notification was treated as sufficient where the assessees deposited the duty-equivalent amount in an escrow account, informed the department, opened separate accounts, and executed the required tripartite agreement. The Tribunal found no diversion or misutilisation of either the principal or the interest, and held that minor procedural lapses could not defeat the exemption when the notification's development objective for the North-East Region had been fulfilled. The duty demand, interest demand, and penalties were set aside. The Tribunal also extended the time for withdrawal from the escrow account and subsequent utilisation, because departmental action had prevented timely compliance and further directions were needed to make the relief effective.

Issues: (i) Whether the appellants were entitled to the benefit of the exemption notification on the basis of deposit of the duty equivalent amount in the Escrow Account and substantial compliance with the notification conditions; (ii) Whether the time for withdrawal from the Escrow Account and subsequent utilisation of the amounts could be extended to give effect to the relief granted.

Issue (i): Whether the appellants were entitled to the benefit of the exemption notification on the basis of deposit of the duty equivalent amount in the Escrow Account and substantial compliance with the notification conditions.

Analysis: The appellants had deposited the equivalent duty amount in the Escrow Account, kept the department informed, and complied with directions to open separate accounts and execute the tripartite agreement. There was no allegation of diversion or misutilisation of the principal amount or the interest earned. The interest was also retained in the Escrow Account and not appropriated by the appellants. The notification was held to be intended to promote development in the North-East Region and was required to be applied in a pragmatic and liberal manner. The failure to comply with some procedural aspects was treated as insufficient to deny the exemption where the substantive object of the notification had been fulfilled.

Conclusion: The appellants were held entitled to the exemption, and the duty demands, interest demand, and penalties were set aside.

Issue (ii): Whether the time for withdrawal from the Escrow Account and subsequent utilisation of the amounts could be extended to give effect to the relief granted.

Analysis: Since the departmental action had prevented timely withdrawal and utilisation within the period prescribed by the notification, further directions were necessary to make the relief effective. The Tribunal found it just and necessary to permit withdrawal for a limited period and to allow utilisation within the stipulated period after such withdrawal.

Conclusion: The time-limit for withdrawal and utilisation was extended by judicial direction.

Final Conclusion: The appeals succeeded, the exemption was allowed on the basis of substantial compliance, and consequential directions were issued to enable effective implementation of the relief.

Ratio Decidendi: Where the substantive conditions of an exemption notification are satisfied and its object is fulfilled, minor procedural irregularities will not defeat the exemption, especially when no diversion or misutilisation of the duty amount or interest is shown.
