The Department had filed References before the Principal Bench (RCP Nos. 27 and 28 of 2001) and opposed interim relief, noting related writ petitions challenging Section 110 of the Finance Act had been dismissed. Court found that because the Department's References are pending before the Principal Bench and the petitioner relied on the earlier CEGAT final orders, 'there is no justification to deny interim relief.' Accordingly, an order of 'interim stay' was granted. Registry was directed to forward the entire appeal records to the Principal Bench at Madras to be heard along with RCP Nos. 27 and 28 of 2001.
