Lesser penalty available for first informer who makes vital cartel disclosure; subsequent informers may receive reduced penalties.

Regulation 4 provides that the first applicant who makes a vital disclosure enabling the Commission to form a prima-facie opinion of a cartel, when the Commission or Director General lacked sufficient evidence, may receive full remission of penalty; subsequent applicants can receive reductions only if their disclosures add materially to existing evidence, with priority-based, scaled reductions for second and third qualifying applicants.
