If determined by Customs authorities that such goods are confiscated under section 111(d) of the Customs Act, 1962, and no legal proceedings are pending, they must be destroyed or disposed of outside normal commerce channels. The right holder must provide a 'no objection' within 20 working days, or it is assumed they agree with the proposed disposal method. Costs for destruction and related charges are borne by the right holder. Re-exportation of infringing goods is prohibited, but samples may be retained for evidence if needed.
