Rights Holders Must Execute Bonds and Notify Customs of IPR Changes Under 2007 Rules for Imported Goods Protection.
The conditions for registration under the Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007, require the right holder or their authorized representative to execute a bond with the Principal Commissioner or Commissioner of Customs. This bond must cover liabilities and costs related to destruction, demurrage, and detention charges. Additionally, an indemnity bond must be executed to protect Customs from liabilities due to suspension of infringing goods. The right holder must inform the Commissioner of Customs about any changes to the Intellectual Property Right status, such as amendments or cancellations, within one month. The Commissioner may amend, suspend, or cancel protection based on these changes.
