Consistency in FATCA application allows adoption of more favorable partner terms automatically unless declined in writing.

India is entitled to any more favorable FATCA terms the United States grants to another partner jurisdiction provided that jurisdiction undertakes the same obligations and is subject to the same terms and conditions; the United States must notify India of such terms, which then apply automatically as if included from the signing date of the other agreement unless India declines in writing.
