Occupational Safety, Health and Working Conditions Code preserves superior employee benefits despite inconsistent laws or agreements.

Section 120 provides that the Code prevails over any inconsistent provisions in other laws or in awards, agreements or contracts of service, subject to a proviso preserving any existing benefits that are more favourable to an employee; those superior benefits continue even if the employee receives other benefits under the Code. The section also permits employees and employers to agree to rights or privileges more favourable than the Code's provisions.
