Provisional safeguard measures allow suspension or increase of customs duty, subject to MFN limits and a fixed time cap.

Provisional safeguard measures may be applied by the Central Government on the basis of preliminary findings of the Director General. The measure may suspend further reduction of customs duty on the concerned good or increase the duty rate, subject to the ceiling of the lesser of the prevailing Most Favoured Nation applied rate or the rate in force immediately before the Trade Agreement entered into force. The measure may remain in force for no more than two hundred days from the date of imposition.
