Adjudication of confiscation: authority for disposal rests with territorial courts or notified subordinate adjudicators.

Adjudication of confiscation vests authority in the Court of Session where the seizure occurred, unconstrained by limit, or in an officer not below Assistant Sessions Judge as notified by the Central Government subject to prescribed limits. After adjudication, the presiding judge may order confiscation, delivery to a person claiming entitled possession, or other disposal of seized articles, currency or securities, including items used in committing an offence under the Act.
