Circular No. PUBLIC NOTICE NO. 136/2018 Dated:- 8-10-2018 Trade Notice Dated:- 8-10-2018 Trade Notic...
The compulsory-registration scheme bars import, sale, manufacture, storage for sale and distribution of notified electronic and IT goods unless they conform to prescribed Indian Standards and are registered after testing by a recognised laboratory. Registration is tied to the manufacturer, factory location, product and brand. Repaired, refurbished and second-hand notified goods need prior registration or a specific exemption. Importers must furnish accurate descriptions and customs tariff classification, upload the registration certificate, and ensure compliant Standard Mark labelling; goods not meeting these requirements must not be cleared.
Reassessment beyond four years fails where original scrutiny considered disclosed claims and no new material exists.
Reassessment initiated beyond four years requires both a reason to believe that income escaped assessment and the assessee's failure to make full and true disclosure of material facts. Where foreign-exchange loss, additional depreciation and interest income were examined during the original scrutiny assessment and supported by records, acceptance of the claims establishes an opinion even without express discussion in the assessment order. Absent new material or a disclosure failure, reopening is an impermissible change of opinion; recorded reasons cannot be supplemented by an unrecorded audit objection, rendering the reopening jurisdictionally invalid.

Punjab GST registration procedures require PAN-linked contact verification through separate one-time passwords, while risk-identified Aadhaar-authenticated applicants must complete biometric authentication, photograph capture and original-document verification at a Facilitation Centre. Input tax credit must be reversed where the supplier fails to furnish the corresponding GSTR-3B by the prescribed deadline, with re-availment permitted after subsequent filing. Differences between GSTR-1 or Invoice Furnishing Facility liability and GSTR-3B liability trigger electronic intimation, payment or explanation requirements, possible recovery, and restrictions on subsequent outward-supply reporting. GSTR-1 is expanded for supplies made through e-commerce operators.
Review jurisdiction requires a self-evident error; a land-unit description already considered cannot reopen factual findings.
Review jurisdiction under Section 114 read with Order XLVII Rule 1 of the Code of Civil Procedure is confined to newly discovered material unavailable despite due diligence, a self-evident error apparent on the face of the record, or analogous sufficient reason. It cannot be used to rehear a matter, revisit factual findings, or replace an existing view with another possible view. Use of "Aare" rather than "Hectare" in a sale deed, where the land-unit description had already been considered in the factual findings, did not constitute an error apparent on the face of the record and did not justify review.
GST interest on late returns excludes timely cash deposits and liabilities covered by available input tax credit.
GST interest for delayed payment is distinguishable from late furnishing of returns. Where the cash portion of tax is deposited by the prescribed due date, late return filing alone does not constitute delayed payment of that amount. In delayed-return situations, the proviso to Section 50(1) limits interest to tax paid through the electronic cash ledger; tax liabilities covered by available input tax credit in the electronic credit ledger are not treated as delayed cash payments. Consequently, an interest demand covering timely deposited cash tax or available input tax credit is unsustainable under the electronic-ledger scheme.
Notification No. G.S.R. 54/P.A.5/2017/S.164/Amd.(61)/2023 Dated:- 9-5-2023 Punjab SGST
Registration suspended for specified cancellation-related contraventions is deemed revoked when all pending returns are furnished unless cancellation has already occurred. Interest on delayed return filing is generally confined to tax paid through the electronic cash ledger, subject to the stated proceedings exception; other unpaid tax and wrongly availed and utilised input tax credit attract interest under separate calculation rules. Export-refund claims receive revised documentation, valuation, mismatch-correction and withholding procedures, while FORM GSTR-3B and annual-return reporting are updated for electronic commerce and input tax credit disclosures.

Use of RFID e-seals supplied by specified vendors and procured or imported from Leghorn Group, Italy, is not permitted for export containers from Nhava Sheva until further orders because of identified security deficiencies. Affected containers dispatched before the restriction must undergo verification that seals are locked, using hand-held readers only. Selected containers may be examined based on exporter status, seal condition, destination, exporter history and commodity. Tampered RFID seals on self-sealed containers are subject to examination.
Costs for certified foreign documents were reduced, balancing judicial delay, accused expenses, and the complainant's production request.
Costs imposed on a complainant seeking production of certified documents under Section 311 of the Code of Criminal Procedure were reduced per complaint. The requested materials were certified copies obtained through earlier requisitions to foreign authorities, but repeated applications and delayed production had consumed judicial time and imposed litigation expense on the accused. Equities were balanced between those costs and the circumstances surrounding the request for production.

Private capital mobilisation is treated as essential to employment generation and productivity growth. Private enterprises, MSMEs and startups should remain central to job creation, with financing assessed by employment and productivity outcomes rather than volume. Guarantees, risk-mitigation instruments, local-currency financing and lower transaction costs are identified as means to expand affordable and predictable access to capital. Methodologies underlying governance indicators should be transparent, objective, evidence-based and responsive to diverse development experiences.

Foreign-origin gold smuggling through the unaccompanied baggage channel involved concealment of gold within hardware items and coordinated retrieval through warehouse personnel and intermediaries. Intelligence-led interception resulted in recovery and seizure of foreign-origin gold concealed in a floor spring, metal locks, a grease gun and a door closer. The arrangement used a trolley secured by a pre-decided number-lock combination, with a warehouse staff member, mediator and receiver allegedly involved in delivery of the concealed gold.

Tax audit penalty cannot rest on books the Revenue simultaneously says were never maintained by the taxpayer.
Tax-audit obligations arise only where books of account exist and are required to be audited. Where the Revenue's position is that the taxpayer maintained no books, it cannot inconsistently impose a penalty for failure to have those books audited. On that basis, a penalty for failure to obtain a tax audit lacks a statutory foundation and is liable to be cancelled.
