Income-tax refund interest without an effective permanent establishment connection attracts treaty taxation on a gross basis.
Article 12 of the India-UK tax treaty distinguishes treaty taxation of interest from business-income treatment where interest is effectively connected with a permanent establishment. Income-tax refund interest without such an effective connection is taxable as income from other sources at 15% of the gross amount. The distinction is relevant where Indian projects have closed and no project revenue arises during the relevant year.

Opening, examination, stuffing changes, re-containerisation and other reworking are prohibited under this procedure.
Change of opinion cannot justify reopening an assessment on previously considered facts without fresh material supporting reassessment.
Reassessment cannot be initiated on a mere change of opinion where the Assessing Officer considered the issue during the original assessment and the proposed reopening relies on the same facts already on record, without fresh material. In those circumstances, reopening is impermissible because a different opinion on previously considered facts is not a basis for reassessment.
Corporate authority to sue requires proof beyond authority to sign pleadings, while photocopies need a foundation for admission.
Order 29 Rule 1 of the Code of Civil Procedure permits specified corporate officers to sign and verify pleadings but does not itself authorise them to institute a suit for the company. Authority to sue must be established, including through the company's constitutional documents or a board resolution. Sections 63 and 65 of the Indian Evidence Act govern secondary evidence and require a foundation for admitting photocopies, including an explanation for missing originals where relevant. A disputed commission debt requires admissible supporting evidence; an unsigned account without underlying records or its preparer's testimony, and an unsupported exchange rate, leave the claim unsubstantiated.

Restricted charitable funds are excluded from income available for application, while usable support and non-corpus fees remain income.
Restricted administrative funds are not income available for application to charitable objects, while capacity-building support available for those objects is income. Transfers require verification of whether restrictions have been released and control has changed. Exemption under section 10(23C)(iv) remains available where approval is valid and activities are charitable. Up to 15% of income may be retained without conditions; excess income may be accumulated for application within five years. Before assessment year 2023-24, Form 10 and purpose specification requirements under section 11 did not apply to such accumulation. Allocating fees to a development fund does not establish payer intent to make corpus contributions; specifically collected corpus payments require verification. Article 289 immunity depends on income being State income, and Article 12's definition of State does not automatically apply.
