Banking concerns consistently valuing Government securities as stock-in-trade may claim deduction for diminution in value and amortisation of premium on securities held to maturity, where the recognised accounting method and applicable banking norms support that treatment. Premium amortisation on held-to-maturity Government securities remains deductible. Provision for depreciation in the value of Government securities is likewise allowable when it accords with the bank's consistently followed valuation practice. The admissibility of both deductions depends on the recognised method of accounting for banking investments.

A third-party statement does not establish accommodation entries when it does not concern the relevant taxpayer, assessment year or subscribing entities. Related-party expenditure is disallowable only when shown excessive or unreasonable against fair market value, legitimate business needs or benefit derived. Service records, invoices, supervisory reports and recipient records supported the payments; without discrepancies or comparable market evidence, risk-management, supervision and consultancy charges remained allowable.

Section 80IA(4) deduction for infrastructure developers does not extend to a joint venture executing a State Government lift-irrigation project as an EPC works contractor. Deduction provisions require strict construction, and the statutory Explanation excludes businesses undertaking works contracts awarded by any person, including a State Government. Mobilisation advances, fixed monthly execution payments, retention money and performance guarantees indicated performance of specified engineering and construction work, not entrepreneurial risk, financial involvement or independent infrastructure development. The deduction was therefore unavailable and the disallowance was sustained.
