Credit-rating restrictions for promoter-connected entities extend conditions concerning common chairmen, directors or employees to securities issued by a promoter's borrowers and subsidiaries, not only associates. Regulation 27(1) was ambiguous on the scope of those conditions and required harmonious construction with the related conflict-of-interest regime in Regulation 28V. Contemporaneous regulatory material and legislative-committee material supported that interpretation. The penalty order was consequently set aside and the appeal allowed.
Proceeds of crime under the PMLA include property derived or obtained, directly or indirectly, from criminal activity relating to a scheduled offence, including its value. Registration of FIRs and charge-sheets alone does not establish that every asset of an accused person or company has that character. Bank-account analysis and PMLA statements tracing project escrow funds towards a property can establish a prima facie nexus. Intermingling of project funds with other money requires examination of the complete money trail; independent income, financial-statement disclosure, or tax-department awareness does not by itself break the connection. Such tracing supports confirmation of attachment.
Statutory appellate remedies against tax adjudication orders were permitted despite limitation objections being waived, subject to compliance with the mandatory pre-deposit requirement. Amounts previously deposited towards the disputed tax demand were to be adjusted against the pre-deposit. Upon satisfying that requirement, the statutory stay applied to the remaining disputed demand. Appeals filed within the specified two-week period were to be entertained and decided on merits without a limitation objection.

GST-evasion bail adjudication requires a case-specific assessment of custodial necessity rather than an automatic consequence of the alleged tax magnitude, Magistrate-triability, or a maximum five-year sentence. Section 132 classification depends on the precise offence clause and punishment bracket, not merely on the alleged quantum of evasion. Relevant considerations include the stage of investigation, cooperation with summons, security of evidence, individual role, risks of absconding or interference, proportionality, and personal liberty under Article 21.
Cross-segment price manipulation may arise where futures orders are allegedly used to move prices or create artificial order-book signals so that larger, economically opposite options positions obtain favourable execution. Section 12A of the SEBI Act and Regulations 3 and 4 of the PFUTP Regulations prohibit manipulative or deceptive devices, false appearances of trading and price manipulation; liability depends on the integrated sequence of orders, price impact, options execution, cancellations, exposure and persistence, rather than opposite positions or LTP contribution alone. Section 27 attributes company contraventions to directors responsible for business conduct, subject to knowledge and due-diligence defences, and separately covers co.....

Preferential customs-duty treatment requires compliance with applicable rules of origin and reliable proof that imported goods qualify as originating. A country-of-origin certificate is important evidence but does not remove the importer's duty to possess supporting origin information and exercise reasonable care. Challenges to preferential treatment must be certificate-specific and consignment-specific: an adverse finding concerning identified certificates cannot, without direct evidence, invalidate separate certificates. Customs verification should identify the particular proof of origin, alleged defect and material linking it to the import, while fraud, suppression or misrepresentation independently established may support substantive action.

Refund of accumulated input tax credit under Section 54(3)(ii) may arise where packing materials used to make taxable packaged outward supplies bear a higher tax rate than the outward supply and generate the accumulation. The inquiry extends to all qualifying inputs and is not limited to a principal raw material. Parity between the rate on bulk tea and packaged tea does not itself preclude refund if higher-taxed packing materials used for the packaged supply are the cause of unutilised credit.

Section 129(3) establishes a mandatory two-stage timeline: issuance of the penalty notice within seven days of formal detention or seizure, followed by a penalty order within seven days of legally effective service. The periods are independent, and compliance at one stage cannot cure delay at the other. Service, portal timestamps and the electronic records required under Rule 142 are material to chronology. Penalty requires a hearing, while payment under protest may still require a reasoned order to preserve appellate access. Later confiscation action cannot ordinarily cure a defective detention adjudication.

A subsisting judicial restraint expressly prohibiting deduction from leave travel concession reimbursements governs the employer's withholding conduct for the covered period. Non-deduction in compliance with that restraint cannot constitute failure to discharge an enforceable duty under Sections 192 and 201, even if the underlying exemption claim is later found substantively unavailable. The restraint does not eliminate employee-level tax liability. For unprotected periods, foreign-leg or circuitous travel claims remain outside the domestic-travel condition, and payer protection may depend on proving employee return filing, income inclusion and tax payment through Form 26A.

Adjustment of an otherwise eligible GST refund towards a demand subject to an operative recovery stay constitutes recovery and cannot bypass that protection. An outstanding demand may remain under appellate challenge, but its existence alone does not establish a present right to recover it. The prescribed appellate pre-deposit, undertaking where required, and timely Tribunal appeal determine recovery protection. A challenge to adjustment of an eligible refund is distinct from a claim for a separately rejected refund amount, which requires independent merits consideration.

The Insolvency and Bankruptcy Code prevails over conflicting income-tax, GST and other legal provisions. During a moratorium, suits, proceedings, execution actions and arbitration against a corporate debtor cannot be instituted or continued. GST show-cause proceedings must remain in abeyance despite potential limitation concerns and may be resumed or initiated after the moratorium is lifted and the corporate insolvency resolution process is completed. GST procedures also address statutory dues following finalisation of IBC proceedings.

GST reform proposals seek to reduce avoidable litigation through effective service of notices, correction of tax-head mismatches without demand proceedings, and protection of the taxpayer's right to personal hearing. They also call for resolution of input-tax-credit disputes, reconsideration of blocked credits and buyer-payment conditions, higher registration thresholds, and fair treatment of trade payables and real estate transactions. Further proposals include eliminating cross-jurisdictional enforcement, flexible processing of legacy-tax refunds, restoring return-linked compliance deadlines, and strengthening appellate tribunal capacity.

Mandatory BIS certification applies under Quality Control Orders effective from 1 and 6 October 2026 to specified hand tools, aluminium utensils and beverage cans, household and commercial electrical appliances, and cement packaging sacks. Manufacturers, importers and suppliers of covered products must assess compliance with applicable product standards, including electrical-appliance safety and prescribed packaging-sack requirements.

Animals used in business otherwise than as stock-in-trade receive a terminal deduction when they die or become permanently useless, equal to actual cost less disposal or carcass realisation. No depreciation is available during their productive use. This approach is criticised as inconsistent with real-income computation because capital cost is not recovered while the animal generates revenue. Depreciation through a block-of-assets framework is proposed for long-lived business animals, based on their reasonably estimable commercial life, changing productive capacity, and alternative commercial uses.

Full payment of admitted tax liability, including admitted interest and penalty where applicable, is mandatory for GST appellate compliance. Mere presentation or registration of an appeal does not meet this requirement if the admitted liability remains unpaid. A procedural lapse may be cured through subsequent full payment, and the second appeal is then treated as filed on the date of cure. Resulting delay may be condoned within the further statutory period where sufficient cause is shown.

Production-linked power assistance that enables an industrial unit to operate more profitably after commencement of production, without an identified contribution towards a new asset or capital outlay, is a revenue receipt. Subsidy designed to set up a new unit or substantially expand an existing unit is a capital receipt. A power subsidy calculated from electricity charges and payable during production is revenue in character.

GST search-and-seizure powers require a separate statutory basis for the property seized and the purpose of retention. Section 67(2) permits seizure of confiscable goods and documents, books, or things useful as evidence; money cannot be treated as confiscable goods merely because it is alleged to be untaxed sale proceeds. "Things" must be read with documents and books, covering articles with an evidentiary purpose rather than unexplained wealth or security for a future tax demand. Reasons to believe require identifiable material linking cash to the statutory conditions for seizure.
Statutory appellate remedy governs challenges to adjudication orders, while Common Portal service remains undecided under the stayed precedent.
Challenges to adjudication orders were required to be pursued through statutory appeals. The validity of service through the Common Portal remained unadjudicated because the operation and effect of earlier precedent on that issue had been stayed by the Supreme Court. Petitioners could file appeals within the stipulated period, and appellate authorities could not object on limitation if the required statutory deposit was made.
CENVAT credit reversal on inputs removed as such prevents their treatment as trading or exempted service.
Removal of PPCP and SAN inputs to moulders after CENVAT credit reversal and payment of VAT/CST does not constitute trading or an exempted service. Consequently, the payment obligation applicable to exempted services does not arise merely because inputs are cleared as such for conversion into battery components. Extended limitation based on suppression is unavailable where departmental Range and Divisional officials knew of the credit availment, removals and reversals, as that knowledge negates suppression with intent to evade duty. The resulting demand, interest and penalty lack legal basis.
Job-Work Permission Does Not Override Duty Conditions for Electricity Generated from Duty-Free Inputs Supplied to Domestic Tariff Area Units
Authorised job work through a Domestic Tariff Area unit does not override the specific exemption conditions governing electricity generated from duty-free furnace oil and supplied in the Domestic Tariff Area. Subcontracting and movement permissions permit authorised production processes but do not exempt every utility supplied to a job worker. Where the recipient has ceased to be an Export Oriented Unit, electricity used for job work remains subject to the applicable duty consequence. Failure expressly to consider cited job-work provisions permits only limited rectification to address that contention, not a review of concluded merits.
