Redemption fine and penalties for attempted export of restricted natural garnet declared as refractory bed material may be sustained where the redetermined value, serious misdeclaration and export restriction through a canalising agency support their quantum. Appellate intervention in discretionary customs sanctions is confined to mala fides or extreme arbitrariness; the rule concerning non-imposition of redemption fine on re-export does not apply to attempted export of restricted goods. Confiscated goods remaining in Customs custody because provisional release was not availed may be e-auctioned under statutory disposal powers, but only after at least 30 days' notice inviting objections and compliance with applicable law and instructions.

Penalty under section 112(b) requires proof that a person dealt in goods liable to confiscation and knew or had reason to believe that the goods were confiscable. An unaddressed retraction and unverified allegations concerning other cigarette owners or the landlord could not establish those requirements, particularly where an invoice supported the claim that certain cigarettes were Indian-made; the penalty was set aside. Foreign-origin rice cookers and ceramic stoves were released on payment of redemption fine because neither confiscation nor release had been properly substantiated and their valuation rested on assumptions.

Penalty for alleged aiding and abetting anti-dumping duty evasion through Malaysian re-routing of Chinese-origin PVC Flex Banner Sheets requires proof of the statutory conditions for liability. The certificates of origin were not verified with Malaysian authorities, and no admissible evidence established that they were false. Retracted statements were relied on without cross-examination, while no specific material proved the appellant's knowledge of or participation in the alleged contravention. On substantially identical allegations, the Tribunal set aside the penalty because the statutory ingredients for its imposition were not established.

Finality of unchallenged Bills of Entry assessments barred a subsequent duty demand on imported networking products. The importer's declared classifications had been accepted and the goods cleared on out-of-charge, causing those assessments to attain finality. Without a challenge to the completed assessments, demand proceedings were unsustainable; the duty demand was set aside, the importer's appeal succeeded, and the Revenue appeal was dismissed as not maintainable.

Ticket resale value remains outside tour operator service taxation where booking is trading without airline commission or additional services.
Purchase and resale of air or train tickets by a tour operator, where no airline commission is received and no additional ticket-booking activity is performed, constitutes trading rather than taxable tour operator service. Accordingly, ticket sale proceeds and the margin earned on booking and resale do not form part of the taxable value of tour operator service. A prior final determination between the same parties on materially identical transactions supports consistent treatment where no factual distinction is established.

E-auction of confiscated goods awaits Tribunal review when the underlying confiscation challenge remains pending in statutory appeal.
E-auction of confiscated goods should not proceed while a statutory appeal challenging the confiscation remains pending before CESTAT. The Tribunal is the appropriate forum to examine all issues concerning the proposed auction alongside the challenge to confiscation. The petitioner may seek consideration of the e-auction before CESTAT, and the auction is deferred until the Tribunal examines the issue. No final determination is made on the legality of either the confiscation or the proposed e-auction.

Case Laws Customs
Import-time customs classification requires communication modules to be assessed as imported, not as parts incorporated after clearance.
Customs classification is determined by the condition and identity of goods at importation, rather than by their intended post-clearance use or transformation. Communication modules imported independently fall under CTI 8517 70 90, not under tariff entries for meter parts merely because they may later be used in meters. Self-assessment requires the importer to assess goods as imported, without anticipating a later contrary departmental view. Prior departmental awareness and acceptance of the declared classification negate intentional misdeclaration or misclassification, making a differential-duty demand and consequential penalties founded on meter-parts classification unsustainable.

Case Laws GST
DIN compliance for GST assessment orders is mandatory; an order issued without DIN is invalid and liable to be set aside.
GST assessment orders must carry a Document Identification Number (DIN) where the GST framework and applicable CBIC circular require DIN-based identification of departmental communications. Absence of a DIN renders the assessment order non est and invalid, making it liable to be set aside.

Prospective application of registration cancellation rules protects charitable registrations from specified-violation allegations predating their commencement.
Cancellation of charitable registration for specified violations cannot rely on the amended section 12AB(4) framework where the alleged violations occurred before 1 April 2022. Absent express or necessarily implied retrospective operation, the law in force for the relevant assessment year governs. The statutory reference and cancellation mechanism introduced from that date therefore could not invalidate registration for earlier conduct; the cancellation was invalid and the registration was restored.

Section 80P deduction covers co-operative society interest income from deposits held with commercial banks under the statutory framework.
Interest income earned by a co-operative society from deposits maintained with a commercial bank is eligible for deduction under section 80P of the Income-tax Act, 1961. The statutory framework applicable to co-operative societies supports deduction of such interest income, making disallowance of the claimed deduction unsustainable. The deduction therefore extends to interest income arising from commercial-bank deposits.

Insolvency moratorium bars continuation of revenue appeals against corporate debtors during the corporate insolvency resolution process.
The statutory moratorium triggered by admission into Corporate Insolvency Resolution Process bars the institution or continuation of proceedings against the corporate debtor. The Insolvency and Bankruptcy Code, 2016 prevails over the Income-tax Act, 1961 through its overriding provision. Consequently, a revenue appeal against a corporate debtor cannot be maintained or proceeded with while the moratorium remains in force.

Self-certified order copy requirement is curable and cannot alone prevent merits-based consideration of an appeal.
Failure to file a self-certified copy of the challenged order is a curable procedural defect, not an independent basis for dismissing an appeal. The assessee must receive an opportunity to rectify the omission before the appeal is rejected. On curing the defect, the appeal should be considered on its merits, ensuring that procedural non-compliance does not foreclose substantive appellate review.

Land development rights transfer treated as immovable-property transfer, excluding developer consideration from service tax.
Transfer of land development rights by landowners to a developer is characterised as transfer of an ownership interest in immovable property rather than a taxable service. Development rights permit the developer to develop land, sell developed property with an undivided interest in the land, and receive purchaser consideration. As benefits arising from land, their transfer falls within the exclusion for transfer of title in immovable property; consequently, no service tax is payable.

Input tax credit eligibility is queried for design-engineering services and architectural drawings used for an IT room within a manufacturing plant, where the work may relate to a civil building. Specific particulars of the proposed inputs and input services, their nature, and their project connection are required to assess eligibility.

Scheduled infrastructure maintenance will temporarily affect GST e-Invoice data retrieval and processing from IRPs, automatic population of e-Invoice data in GSTR-1, and e-Invoice JSON downloads through the portal and application programming interfaces. Taxpayers and other stakeholders should plan related activities around the maintenance period, with services expected to resume upon completion.

Conditional leave to defend orders in commercial summary suits are not appealable under the Commercial Courts Act.
Section 13 of the Commercial Courts Act confines appeals in commercial matters to decrees, orders expressly listed in Order XLIII Rule 1 of the Code of Civil Procedure, and orders appealable under the Arbitration and Conciliation Act. Conditional leave to defend under Order XXXVII Rule 3 is an order, not a decree, and is not included among the specified appealable orders. The 2018 substitution of "decision" with "judgment or order" did not expand appellate jurisdiction. Clause 15 of the Letters Patent is also unavailable for commercial suits, so conditional leave orders cannot be appealed.

Comprehensive trade agreements are treated as instruments of global economic integration rather than tariff-reduction arrangements alone. Their scope includes preferential market access, protection of sensitive sectors, access to high-technology products, services, investment, skill development, technology partnerships and climate cooperation. Agreements are to be shaped through stakeholder consultations and preserve defensive interests while reflecting comparative advantage, competitiveness and complementary trade relationships. Innovation requires collaboration between public institutions, private enterprise and academia, with government functioning as a facilitator and catalyst for private-sector-led innovation.

Sections 120 and 168 of the Central Goods and Services Tax Act, 2017 make monetary-limit directions binding within the Central tax hierarchy, while they regulate the executive decision to file rather than create an inflexible jurisdictional bar before the Tribunal. In a composite order disposing of multiple appeals or demand notices, the relevant amount is the total disputed tax, interest, penalty or late fee, as applicable. The recurring or interpretative-issue exclusion requires a reasoned, case-specific basis, and Commissioner authorisation does not itself establish compliance with the litigation policy.

Alleged re-use of invoices and e-way bills requires the seizing authority to establish through positive, corroborated evidence that the intercepted goods are the same consignment previously transported under those documents. Toll data, vehicle movements and photographs may justify inquiry but do not alone prove prior delivery, identity of goods or re-use. Where invoices and e-way bills accompany the goods and physical verification shows no discrepancy, the authority must investigate and address any explanation of a different earlier consignment. Cases involving absent or expired transport documents remain factually distinct.

2026 (9) TMI 2054 - GSTAT CHANDIGARH AT
Under Rule 89(4), invoice values for goods invoiced before or at removal for export under bond or Letter of Undertaking may be included in zero-rated turnover for the relevant refund period, although physical export occurs later. The invoice and removal determine period-wise attribution for the refund formula, while actual export remains essential to sustain the claim. Shipping bills, bills of export and related export records must correlate with the export invoices to establish that the goods were ultimately exported. Compliance with valuation, input tax credit eligibility and bond or Letter of Undertaking conditions remains necessary.
