Recovery of an outstanding demand may be restrained while a statutory appeal remains pending, alongside directions for prompt appellate disposal. The appellate authority is required to decide the appeal within the stipulated period by a speaking and reasoned order after giving the taxpayer an opportunity of hearing. Interim protection against recovery continues until final disposal of the appeal, preserving the taxpayer's position pending the appellate decision.
Consideration received for assigning rights, claims and entitlements connected with disputed partnership property and litigation is capital in character where it represents either an enforceable beneficial or proprietary interest or merely a litigative right or right to sue. Complete divestment of the underlying source does not become revenue income merely because capital gains tax may not apply; the residuary income head applies only to receipts that are first income. The addition as income from other sources was therefore deleted. Expenditure claimed against interest income remains deductible only when proved to have been incurred wholly and exclusively to earn that income. As no direct and proximate nexus was established, the disallowance was sustained.
Regional support-service consideration falls outside royalty treatment under the India-Singapore DTAA and domestic law where the provider merely applies its own expertise and does not transfer a right to use industrial, commercial or scientific experience or impart deployable knowledge. It also does not constitute fees for technical services unless technical knowledge, experience, skill, know-how or processes are made available so the recipient can apply them independently. Continued reliance on the provider indicates that this condition is unmet. Such receipts are business profits and are not taxable in India absent a permanent establishment. TDS credit remains subject to factual verification and grant according to law.
Excess business stock comprising regularly traded commodities, found at business premises and explained as arising from suppressed business profits, retains the character of undisclosed business income where no material establishes an extraneous source. Mere non-recording of purchases does not justify treating the stock as unexplained investment. The higher tax rate for deemed income applies only after valid invocation of the relevant deeming provision; consequently, the excess stock is taxable under normal provisions. Interest for delayed return filing remains mandatory but must be computed from the statutory due date, actual filing date and verified period of default, after credit for interest already charged or paid.
Genuineness of dematerialised equity-share transactions supporting a long-term capital-gains claim depends on documentary evidence, banking-channel payments and identifiable transaction records. Where taxpayers produce such evidence, an allegation that share-sale proceeds constitute unexplained cash credit requires specific defects or rebuttal of the material. An alleged commission expenditure linked solely to the asserted bogus share-sale proceeds is consequential and cannot independently sustain disallowance where the underlying allegation fails.
Transfer-pricing treatment of corporate guarantees and interest on convertible loans followed consistent prior-year treatment where no factual difference was shown. Payments to non-residents, product, trademark and patent registration expenses, in-house research and development deductions, vehicle depreciation, and partner remuneration were also addressed through established prior-year positions. Exempt-income expenditure disallowance is computed only by reference to investments yielding exempt income; foreign investments generating taxable dividends require exclusion, subject to verification. Foreign-currency royalty receipts already recorded and offered to tax cannot be treated as undisclosed income without supporting material. Employee contributions already disallowed by the taxpayer cannot be disallowed again.
Characterisation of losses on transfer of real-estate allotment rights depends on their actual treatment and supporting evidence, not book entries alone. Where the rights were recorded as short-term loans and advances rather than closing stock, and the claimed business loss was not substantiated, they were treated as capital assets. The resulting loss remained eligible for indexation and carry-forward as long-term capital loss. Where interest is claimed as part of acquisition cost, conflicting positions require fresh computation after the taxpayer is given an opportunity to provide supporting evidence.
Section 56(2)(viib) applies when consideration is received for the issue of shares. Fully and compulsorily convertible debentures retain their character as debentures until conversion; compulsory future conversion does not treat them as shares on the date consideration is received. Neither section 56(2)(viib) nor Rule 11UA creates a deeming rule that classifies unconverted FCCDs as shares. The original issue of convertible debentures and the later issue of shares on conversion are distinct events, and conversion without fresh consideration does not independently trigger the provision. Regulatory or insolvency classifications cannot expand the charging language of the Income-tax Act.

Rental receipts credited, accounted for and assessed in a registered partnership firm's hands remain taxable to the firm; partners' capital-account withdrawals do not constitute rental income or transfer ownership of the building. Under a registered joint development agreement granting the developer effective possession, dominion and authority over the property, transfer occurs on execution of the agreement rather than on later delivery of constructed area. The special capital-gains regime for joint development agreements operates prospectively and does not apply to earlier transactions. Rough, unparticularised loose sheets without independent corroboration cannot support additions for undisclosed or underreported rental income. The rental-income additions were deleted and later-year capital-gains additions were set aside.
Section 153D approval of draft search-assessment orders operates as a safeguard against arbitrary assessment and requires independent application of mind to the material and reasoning for each assessment year. A consolidated approval that does not record examination or movement of files, provide separate year-wise approvals, or state reasons is mechanical and fails the prior-approval requirement. Such defective approval invalidates the consequential assessment order; the assessment was therefore treated as void and quashed, while the remaining grounds were left open.
Concurrent factual findings established that the appellant had transferred title to the imported goods and was not their owner. The goods were consigned to fictitious importing firms lacking importer-exporter codes and were routed without proper banking channels, supporting findings of systematic fraud and illegal importation. These factual findings warranted confiscation and penalty and did not raise a substantial question of law. Confiscation, refusal of re-shipment and penalty were sustained, and the customs appeal was dismissed.
Medical relief includes mobile healthcare services delivered to rural and remote populations under Government contracts where the objects remain exclusively charitable and prohibit commercial operation. Contractual receipts, tax deduction at source and surplus generation do not alone convert such activities into business; the decisive considerations are the institution's purpose and deployment of income. Regular charitable registration cannot be refused merely because beneficiary records are held by the Government or payments are made to related persons, absent proof that payments were excessive or unreasonable for services rendered. Cancellation of provisional registration requires specific notice of the statutory ground and an effective opportunity to respond. Regular registration was directed, and the provisional-registration cancellation was set aside.
Section 12AB cancellation requires cogent material showing that charitable activities are not genuine, depart from stated objects, or meet another specified statutory ground. Deficiencies concerning expenditure, application of income, investments or compliance with other laws ordinarily belong in assessment proceedings unless they establish abandonment of charitable purposes. Incidental examination and mobile-tower receipts, educational surplus retained for infrastructure, an unregistered lease, and family management without prohibited private benefit do not alone establish profiteering or specified violations. Registration was restored, and the consequential Form 10AB rejection, based solely on cancellation, was reversed with a direction to grant appropriate registration.
Export incentives directly connected with export activity are treated as operating income when computing the tested party's profit level indicator under the Transactional Net Margin Method. Excluding such incentives can distort the tested party's operating margin, particularly where incentives received by comparable companies are included in their operating income. The operating and arm's-length margins should therefore be recomputed after including eligible export incentives in the tested party's operating results.
Search material found at a third party's premises must be used for assessment or reassessment under section 153C, not a regular section 143(3) assessment; where the relevant assessment was pending and abated, the section 143(3) assessment was invalid and quashed. Section 14A read with rule 8D does not permit expenditure disallowance without exempt income, and the corresponding book-profit adjustment was deleted. Foreign-exchange loss on revenue-account liabilities, recognised under Accounting Standard-11, is allowable as business expenditure. An addition based solely on undisclosed third-party material, without disclosure or cross-examination, breaches natural justice; search presumptions do not apply against the assessee, and the capital-gains addition was deleted.
Food safety examination of imported roasted areca nuts must be conducted by the competent Food Safety Authority under the applicable statutory procedure where the inquiry concerns the product's nature, composition, roasting status, moisture content and fitness for human consumption. Representative samples of the imported consignment are to be forwarded to the jurisdictional food safety authority for testing of those parameters. Customs authorities may also send samples to SIIB and may take further action in accordance with law based on the competent authority's report and other available material.
Customs exemption-notification amendments operate prospectively unless they expressly provide otherwise. Where bills of lading predate an amendment's commencement, that amendment cannot govern the imports or justify refusing to consider provisional release of highly specialised equipment. Provisional release must instead be considered under the Customs Act, with lawful conditions imposed where necessary. Goods may be released upon compliance with those conditions, while adjudication on the merits continues.
Customs exemption notifications operate prospectively unless they expressly provide retrospective effect; an amendment effective after the relevant Bills of Lading cannot govern those imports. Mere courier declarations and concealed prohibited goods did not prove knowledge, intent or facilitation; the penalties and impugned order were set aside.
