After negotiations between the parties, it was agreed that the defendant will utilize the services of the plaintiff and will pay the fee to the plaintiff equivalent to two months' rent as would be agreed between the defendant and its lessee. 3. The plaintiff has again issued notice to the defendant calling upon the defendant to pay the balance settlement amount of Rs. 21,28,000/- but the defendant has not paid the same. Evidence for hearing of summary judgment.-(1) Notwithstanding anything in this Order, if the respondent in an application for summary judgment wishes to rely on additional documentary evidence during the hearing, the respondent must:- (a) file such documentary evidence; and (b) serve copies of such documentary evidence on every other party to the application at least fifteen days prior to the date of the hearing. ....led the present application praying for summary judgment relying upon the Letter of Intent dated 18th December, 2017 wherein Kalyan Jewellers intents to take the commercial premises on lease for a period of 15 years on a monthly rent of Rs. 23,00,000/- plus GST. The Letter of Intent is not in dispute. 17. The plaintiff has relied upon lease agreement which is undated entered between the defendant and Kalyan Jewellers India Limited with respect to the commercial premises.
