Learned counsel for the assessee submits that the Tribunal was not justified in making a distinction between incomes falling under different heads for the purpose of application of section 161 of the Act. Similarly, dealing with computation of advance tax in section 209, it has been clearly provided that out of the total income of the latest previous year in respect of which the assessee had been assessed by way of regular assessment, the amount of capital gains, if any, included in such income shall be excluded.
