....le ground of the appeal is against deletion of penalty imposed u/s 271(1)(C) at Rs. 12,63,208/- for A.Y. 03-04 and Rs. 3,66,715/- for A.Y. 04-05. 2. The fact for A.Y. 03-04 are that the assessee had claimed bad debt of Rs. 34,09,456/- in the name of M/s CMC Machinery in Profit and Loss Account but account of the party had not been written off . The Ld. AO did not find this debt as bad and added back in the income of the assessee. The penalty proceeded u/s 271(1)(C) was initiated by the AO for furnishing of inaccurate particulars of income in the course of the assessment proceedings. In appeal before the Co-ordinate "D" Bench Ahmedabad in ITA No. 2857/Ahd/2006 A.Y. 03-04 has confirmed the addition. The operative part is as under: ....
