The learned Counsel also refers to the meaning of the expression "right to reproduce the imported goods" as clarified by the World Customs Organization. ....so a similar issue was considered and wherein also royalty was paid in respect of corn and sunflower seeds which were used for production in India. In the said decision, it was held that royalty paid for the reproduction in India cannot be added to the value of the seeds at the time of importation. He submits that this decision has been accepted by the department and has not been taken in appeal before any higher forum. In view of the above, he pleads for setting aside the impugned order and allowing the appeal. 3.
