ANNEXURE CONVENTION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDIA AND THE GOVERNMENT OF NEW ZEALAND FOR THE AVOIDANCE OF DOUBLE TAXATION AND THE PREVENTION O FISCAL EVASION WITH RESPECT TO TAXES ON INCOME The Government of the Republic of India and the Government of New Zealand, desiring to conclude a Convention for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income. Have agreed as follows: ARTICLE 1 PERSONAL SCOPE This Convention shall apply to persons who are residents of one or both of the Contracting States. ARTICLE 2 TAXES COVERED 1. The existing taxes to which the Convention shall apply are: (a) in the case of New Zealand: the income tax and the excess retention tax (hereinafter referred to as "New Zealand tax"); (b) in the case of India: the income tax including any surcharge thereon and the surtax (hereinafter referred to as "Indian tax"). 2. .... ARTICLE 10 DIVIDENDS 1. Dividends paid by a company which is a resident of a Contracting State to a resident of the other Contracting State may be taxed in that other State. 2. However, such dividends may also be taxed in the Contracting State of which the company paying the dividends is a resident and according to the laws of that State, but if the recipient is the beneficial owner of the dividends, the tax so charged shall not exceed 20 per cent of the gross amount of the dividends. The competent authorities of the Contracting States shall by mutual agreement settle the mode of application of this limitation. The paragraph shall not affect the taxation of the company in respect of the profits out of which the dividends are paid. 3. ....he Contracting States shall exchange such information (including documents) as is necessary for carrying out the provisions of this Convention or of the domestic law of the Contracting States concerning taxes covered by the Convention in so far as the taxation thereunder is not contrary to the Convention, in particular for the prevention of fraud or evasion of such taxes.
