....hese appeals is that the assessee, being a charitable institution has been denied the benefit available under section 10(23C) (iiiad) as well as the benefit of section 11. In the grounds of appeal filed before the Tribunal the assessee has raised two sets of contentions. The first set of contentions is against the jurisdiction of the assessing authority in reopening the impugned assessments. The second set of contentions is against the findings of the lower authorities that the assessee is not entitled for the benefits available either under section 10(23C)(iiiad) or under section 11 of the Income-tax Act, 1961. In the said judgment the hon'ble High Court has held that the provisions of sections 12, 13(3)(b) and 13(1)(c) could not be invoked without looking into the substance of the transaction and without ascertaining the real nature of the transaction. The court continued to observe that it is pertinent to note that it was not the case of the Department that the beneficiary has sufficient wherewithal. The assessing authority failed to appreciate that the trustee had reimbursed the sum and had agreed to reimburse the balance. The hon'ble court continued to observe that the Assessing Officer cannot ignore the constitutional b....
