The Bombay High Court decision referred to by the learned advocate for the opposite party No. 1 no doubt deals with a case which was brought not only under section 630 but also under sections 120B/406 and 428 of the Indian Penal Code. But in that case the dispute was not between the Company and its employee. It was a dispute between two brothers. The perspective there was totally different from what it is obtaining in the present case where the employer-employee relationship between the parties at all material time is not in dispute.
