....t satisfied, the Board clarified that the department may follow the earlier instruction which had suggested reliance upon the best judgement assessment rule". We find that the criteria laid down for assessment of DTA clearance by EOU unit in the goods clarification are very relevant to the impugned order which has not dealt with the issue based on that reference to the clarification given by the Board. Even though there is a reference to case law cited before the Commissioner as well as some Public Notice, we are of the view that the methodology in the Board clarification ought to be considered for application in the present case.
