Prohibition on import of milk products extended, maintaining ban on milk based food imports from China for a further period.
The Central Government, invoking powers under the Foreign Trade (Development and Regulation) Act and paragraph 2.1 of the Foreign Trade Policy, 2009-14, extends the prohibition on import of milk and milk products from China-including chocolates, chocolate products, candies, confectionery and food preparations with milk or milk solids-for a further six month period from 24 December 2009 and until further orders, issued in public interest by the Director General of Foreign Trade.

Minimum Export Price requirement revised to exclude foreign commission, requiring exporters to add commission to the MEP.
Where any foreign commission is paid at the time of export or subsequently, the MEP must be increased by the amount of such foreign commission, and the prescribed MEP shall be maintained exclusive of foreign commission.

Export of organic non-basmati rice permitted subject to certification, contract registration and shipment from EDI ports.
Export of organic Non-basmati rice is permitted despite the general ban, provided the rice is certified as organic by the designated authority, exports comply with an annual aggregate quantity limit, contracts are registered with the designated export promotion authority prior to shipment, and shipments are made only from Customs EDI-enabled ports. Monthly monitoring of exported quantities by customs and trade statistics authorities is required, with reports to the Department of Commerce/foreign trade administration and the food and public distribution department; all other notification provisions continue to apply.

Export of organic wheat permitted with certification, contract registration, EDI-port shipments, and monthly monitoring under trade policy.
Export of organic wheat is permitted notwithstanding the ban, provided the wheat is certified as organic by the designated authority, export contracts are registered with the export promotion authority prior to shipment, exports occur only from Customs EDI-enabled ports, and exported quantities are monitored monthly by customs and statistical agencies with reports to commerce and food distribution authorities.

Export of edible oils in consumer packs permitted subject to branded-pack and port conditions under amended foreign trade policy.
The Central Government amends prior notifications to permit export of edible oils in branded consumer packs subject to a pack size ceiling and an overall export quantity cap for the policy period, and restricts such exports to shipments through Customs EDI-enabled ports.

Prohibition on exports and imports to DPRK of items and technology that could aid nuclear or WMD programmes.
A prohibition on direct or indirect export to and import from the Democratic People's Republic of Korea is established for all items, materials, equipment, goods and technology that could contribute to DPRK's nuclear-related, ballistic missile-related or other weapons of mass destruction-related programmes, applying irrespective of the items' origin and referencing specified United Nations Security Council and IAEA lists.

Import licence eligibility for rough marble blocks restricted to units owning marble gang saw machines; leased machines excluded.
Eligibility for import licences for rough marble blocks/slabs is limited to units owning an installed marble gang saw machine registered in the applicant's name; leased gang saws are excluded, 100% EOUs and SEZ units are not eligible, and applicants must have been in operation for five years prior to 1st April of the current licensing year.

Import licensing conditions for rough marble set eligibility, floor price endorsement, pro rata entitlement and monthly reporting.
Revised import licensing regime for rough marble blocks/slabs effective 1 October 2009: imports under specified EXIM codes are restricted and licences must bear a prescribed floor price. Eligibility requires ownership of a marble gang saw machine, five years' operation prior to 1 April of the licensing year, and specified indigenous sales turnover in processed slabs/tiles for each of the preceding five years. Licences are allocated pro rata based on five year average sales subject to an annual ceiling and per unit machine caps, issued on actual user condition, and require monthly import returns and State verification prior to DGFT consideration.

Unique device identifiers: import of mobile handsets without valid IMEI/ESN/MEID is prohibited, altering import compliance.
Importation of handsets under ITC (HS) Code 8517 without a valid IMEI or with an all-zero IMEI is prohibited; likewise, importation of CDMA phones without a valid ESN or MEID, or with these identifiers all zeroes, is prohibited. The prohibition amends Schedule I of the ITC (HS) Classification under the Foreign Trade (Development and Regulation) Act and the Foreign Trade Policy and is stated to be in the public interest.

Import prohibition on wild animals with mandatory CITES compliance for listed species under amended trade policy.
Import of wild animals, including their parts and products, is prohibited and, for species listed in CITES, is subject to CITES provisions. An Import Licensing Note inserted at the end of Chapter 96 states this prohibition and CITES applicability. A Note for Chapter 14 makes import of Red Sanders Powder subject to CITES. Select Exim codes for fur items are designated Free for import but expressly conditioned on compliance with the Wildlife (Protection) Act, 1972 and CITES.

Import licensing for marble now subject to specified policy circular conditions under the Foreign Trade Policy, affecting import procedures.
The Import Licensing Note at the end of Chapter 25 is amended to require that import of marble be subject to the conditions and procedures specified in the Policy Circulars referenced in the notification, making those circulars the operative licensing criteria for marble imports under Schedule-I (Imports) of the ITC (HS) Classification.

Import policy for electrical energy now requires an import licence; SEZ-origin imports remain exempt.
Import of electrical energy (ITC(HS) 2716 00 00) is made Restricted, requiring an import licence issued by the central licensing authority in consultation with external affairs, power and commerce departments; imports from SEZ are Free. Notification No. 9/2009-2014 is withdrawn and the amendment is effective from 8th September, 2009 under the Foreign Trade (Development and Regulation) Act and Foreign Trade Policy 2009-14.

Export classification amendment: Lanolin added to animal fats and oils item description, altering export schedule immediately.
The export classification at Chapter 15, Schedule II, Sl. No. 67 is amended to read: 'Tallow, fat and / or oils of any animal origin excluding fish oil and Lanolin.' This substitution to the ITC(HS) item description is issued under the Foreign Trade (Development & Regulation) Act and the Foreign Trade Policy and takes immediate effect as a regulatory amendment to the export schedule.

Import restriction on electrical energy requires licence from designated authority with ministerial consultation; SEZ imports free.
Electrical energy (Exim code 27160000) is designated Restricted, subject to an import licence issued by the designated foreign trade authority in consultation with relevant ministries; imports from Special Economic Zone units are Free. The classification change is effected under the Foreign Trade Policy framework and was later withdrawn by a subsequent notification.

Import policy change: carbon black and polyester products designated free for import under foreign trade policy authority.
Under powers of the Foreign Trade (Development and Regulation) Act and paragraph 2.1 of the Foreign Trade Policy, Schedule I (Imports) of the ITC(HS) is amended to classify carbon black and specified polyester products as Free for import, with corresponding ITC(HS)/Exim classification entries and no additional policy conditions.

Import restriction on electrical energy requires DGFT license following consultation with external affairs, power and commerce ministries.
Electrical Energy is classified as Restricted under the ITC(HS) and imports are subject to a licensing requirement to be issued by the Directorate General of Foreign Trade in consultation with relevant central ministries; the amendment is made under powers of the Foreign Trade (Development and Regulation) Act and paragraph 2.1 of the Foreign Trade Policy.

Export relaxation for shed antler shavings permits case-by-case export subject to Legal Procurement Certificates and pre-shipment inspections.
Temporary relaxation permits export of shavings of shed antlers of Chital and Sambhar until 30.09.2009 subject to a one-time exemption. Exporters must apply to DGFT within 30 days, obtain a Legal Procurement Certificate from the Chief Wildlife Warden following physical stock verification, and have State Governments refer cases with that certificate to the Ministry of Environment & Forests; the Ministry will recommend export to DGFT on a case-by-case basis. Each consignment is subject to pre-shipment inspection. The permission covers only material left from the earlier extension, not newly procured stock.

Minimum Export Price for rice requires FOB to meet the prescribed threshold, with limited commission allowance.
Export of rice permitted only if the Minimum Export Price (MEP) is US $900 per ton or Rs. 41,400 per ton FOB. For Basmati rice, foreign commission up to 12.5% is allowed for computation of MEP; any discount or commission in excess of 12.5% will not be allowed for calculation of MEP, requiring FOB price to be higher accordingly.

Prohibition on export of edible oils; limited branded consumer-pack exports allowed under capped quantity and port restrictions.
Amendments impose a prohibition on the export of edible oils by substituting the ban's applicability period and preserve earlier relaxations; they also permit limited exports in branded consumer packs up to 5 Kg subject to an aggregate cap and only from Customs EDI ports, under authority of the Foreign Trade (Development & Regulation) Act and the Foreign Trade Policy.

Export restrictions on wildlife and CITES listed species impose certification, licensing and documentation requirements for plant, timber and fertilizer exports.
The notification amends ITC (HS) Table B to prohibit export of species listed under the Wild Life (Protection) Act and to subject CITES listed species to CITES provisions; it distinguishes plant materials by origin and CITES/Act listing, permitting exports only with specified certificates, nursery registration or DGFT exemptions for research/medical purposes. It requires licences and CITES documentation for value added Red Sanders products and subjects finished handicraft timber products to CITES. Exports of specified fertilizers are restricted to approved manufacturers or direct importers with prior Department of Fertilizer permission and supporting auditor declarations and Customs production.
