Excise Duty Exemptions Amended: Branded Goods Excluded Except for Specific Organizations Under Central Excise Act, 1944.
The Central Government has amended Notification No. 88/88-Central Excise, dated March 1, 1988, under the Central Excise Act, 1944, to exclude certain goods from excise duty exemptions if they bear a brand name or trade name. The exemption will not apply to goods with brand names or trade names, except those of the manufacturer, Khadi and Village Industries Commission, State Khadi and Village Industries Boards, National Small Industries Corporation, or State Industries Development Corporations. The amendment also clarifies that a brand name or trade name includes any name or mark indicating a trade connection, regardless of registration.
