Summary: The High Court held that the Commissioner qualifies as the Adjudicating Authority for purposes of interest on delayed refund under the pre-amendment Section 35FF, entitling the appellant to statutory interest where the refund was not made within three months from service of the appellate order on the Commissioner; the Finance (No. 2) Act, 2014 later prospectively amended the regime to make interest accrue from date of payment for post-amendment pre-deposits and the administration issued directions for prompt refund processing.
