      By: Dr. Sanjiv Agarwal
Summary: GST will subsume many overlapping levies for intangible goods and services, resolving dual VAT/service tax treatment by applying a single tax; electricity's inclusion is uncertain and crucial to allow input tax set offs after abolition of concessional inter state purchase rates; tourism, hospitality and restaurants may face higher revenue neutral rates though restaurants could be relieved of double taxation; major commodities-petroleum, alcoholic liquor and tobacco-are carved out or specially treated to preserve state revenues, raising questions on parallel VAT/CENVAT, excise coexistence, and input credit mechanisms.
      By: DEVKUMAR KOTHARI
Summary: Expenditure on free samples and modest gifts to doctors is deductible when serving bona fide promotional or educational purposes and not expressly unlawful; branded giveaways may constitute advertising rather than prohibited gifts, and an administrative circular disallowing such costs is not retrospective and cannot be applied to assessment years before its effective date.

Summary: The document announces a centralized online platform for Non-Tax Receipts enabling electronic payments via Credit Card, Debit Card or Net Banking through a Payment Gateway Aggregator (SBI e-Pay). The portal provides an end-to-end solution to replace physical instruments, improve timeliness of deposits, and support reconciliation and accounting by government Ministries and Departments; inaugural use included an interim dividend remitted by NTPC.
Summary: The Reserve Bank of India urges assessees to remit income tax dues sufficiently in advance of the due date and to use authorised agency banks or the online payment facilities of those banks as alternatives to paying at RBI counters, thereby avoiding heavy end period queues and delays in receipt issuance.
Summary: SIT identifies Trade Based Money Laundering as a principal channel for illicit outflows and recommends a dedicated institutional mechanism to examine export-import data mismatches and cross check commodity prices. The SIT obtained country wise calculations from an independent report estimating illicit financial flows for 2004-2013 and sent those details to the revenue intelligence agency on 8 February 2016 for verification; further action by the SIT will follow receipt of that verification report.
Summary: WPI for all commodities fell to 175.7 in January 2016, producing an annual inflation rate of -0.90%. Declines were driven by primary articles and fuel & power-particularly lower food articles, minerals, furnace oil, aviation turbine fuel, diesel and petrol-while manufactured products recorded a slight monthly increase with mixed movements across food products, textiles, chemicals and metals.
Summary: Make In India Week activities at the MMRDA Grounds proceeded as scheduled after a venue safety and fire audit review following an accidental nearby fire; the main centre was confirmed secure and public safety assessments supported continuation of seminars, exhibitions and related events.
Summary: The Reserve Bank of India published the Reference Rate for the US dollar as the primary rupee benchmark and provided euro, pound sterling and yen exchange rates derived from that reference using middle rates of cross-currency quotes; it further states the SDR Rupee rate will be based on the Reference Rate.

      1/2016 - dated 15-2-2016
Clarification of the term 'initial assessment year' in section 80IA (5) of the Income-tax Act, 1961
Summary: The term initial assessment year means the first assessment year opted for by the assessee for claiming the ten consecutive-year deduction; once opted, the assessee is entitled to claim deduction for ten consecutive years beginning from that chosen year, subject to statutory conditions, without exceeding the overall prescribed ceiling and with the claim period being continuous. Assessing officers must allow deduction accordingly after verifying conditions and refrain from pursuing litigation that treats the year of commencement as the initial assessment year contrary to this interpretation.
