Validity of electronic summons in PMLA probes: email service inadequate; physical CrPC service required, nullifying summons and enabling acquittal
Personal liberty is affirmed as sacrosanct and the Fundamental Right to movement applies to public officeholders; any restriction must conform to reasonable procedure, immediately placing the burden on investigators to follow statutory procedure. The summons sent by email in PMLA-linked investigations was held legally inadequate because PMLA incorporation of CrPC mandates physical modes of service and, after due diligence, extended or substituted service, and failure to comply with those procedures precludes legal consequences. Investigation must involve fieldwork, proper case diary entries and proof of receipt, and noncompliance by the investigating agency negates the efficacy of the summons.
