The authority rejected intermediary immunity where platforms facilitate listing/hosting without effective due diligence, clarifying intermediaries remain liable absent proactive compliance and leading to delistings and liability exposure. CCPA issued mandatory guidelines and self-audit requirements, obliging platforms to verify ETA/frequency compliance, disclose licensing requirements, deploy automated monitoring/takedown mechanisms, and publish audit certificates.
