Police oppose ED bid to shift Kodakara hawala heist trial to PMLA forum, call request misconceived, premature
Kerala police, through the investigating officer, has opposed an Enforcement Directorate request to transfer the Kodakara hawala money heist case to a special PMLA court, calling the move misconceived and without jurisdiction. The officer argued that IPC offences under investigation and alleged PMLA offences are separate, and only the court that took cognisance of the scheduled offence-the Principal Sessions Court, Thrissur-can order transfer, not the Additional Sessions Court currently hearing the matter. The affidavit also notes ED has not filed any complaint or charge sheet under PMLA or shown cognisance by the special court, and that transfer at an advanced trial stage would prejudice the prosecution.
