<h1>Cancellation of ePoS Letter of Intent held valid; no binding contract formed, fresh tender allowed with equal participation</h1> The Supreme Court upheld Himachal Pradesh's cancellation of a Letter of Intent (LoI) awarded to a private company for supply of upgraded ePoS devices for Fair Price Shops, setting aside a 2024 High Court order that had restored the LoI. The Court held that the LoI of September 2, 2022 did not create a binding contract and its cancellation in June 2023 was a lawful exercise of administrative discretion, not arbitrary or violative of natural justice. The state is permitted to issue a fresh tender in accordance with procurement rules, and the private firm may participate subject to uniform eligibility conditions.
