Permanent injunction and Rs 2 lakh damages for trademark infringement under Section 29 over 'Karim's Food' confusing use
A Delhi court granted a permanent injunction in a trademark suit brought by a Delhi restaurant chain against a Rampur eatery, finding the latter's use of the name 'Karim's Food' to be visually, phonetically and conceptually deceptively similar to the plaintiff's reputed marks and likely to cause loss of goodwill and reputation. The court restrained the defendant, its agents and representatives from using 'Karim's Food' or any mark identical to the plaintiff's registered trademark and awarded the plaintiff Rs 2 lakh as punitive damages.
