The single judge had found the CoI would run parallel to and interfere with ongoing PMLA criminal proceedings, potentially prejudicing the accused, and noted a CoI is a fact-finding, non-adjudicatory body. The court left the question of the state's legislative competence to appoint the CoI for the single judge's final hearing.
