Call for senior judge to supervise hybrid resolution to finish stalled mixed-use tower, remove promoters, install new board
The Supreme Court was urged to order a court-monitored hybrid resolution mechanism, modelled on prior realty insolvency interventions, to complete a stalled mixed-use tower project developed by a group company now in insolvency. The amicus recommended appointment of a former senior judge to supervise the process, removal of promoter control, exclusion of key management from the resolution, appointment of a new board and project management consultant, forensic audit of group accounts, and replacement of the interim resolution professional. The proposal stressed balancing financial creditors' interests with delivery to homebuyers and invoked the court's plenary powers to fashion equitable relief; further hearings were scheduled.
