<h1>Preventive detention under COFEPOSA bars bail despite earlier default bail; detention maintained during the statutory term.</h1> Preventive detention under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act (COFEPOSA) was applied to a person suspected of gold smuggling, and the Advisory Board directed that bail not be permitted during the period of detention. Although a city court had earlier granted default bail due to non-filing of a chargesheet, the COFEPOSA order continued to lawfully restrain release, demonstrating that preventive detention under the Act can operate independently of and supersede ordinary bail relief while suspicion of smuggling persists.
