Indian Carriers Permitted to import Aviation Turbine Fuel

Import of Aviation Turbine Fuel (ATF) bearing ITC (HS) Code 2710 19 20 is under STE regime. Therefore, only certain State Trading Enterprises (STEs) of Government of India are permitted to import ATF as of now. Representations have been received to permit airlines to import ATF directly. The matter has been under consideration.

Group of Ministers(GOM) on Civil Aviation has also considered the matter. In its meeting held on 7.2.2012, GOM decided that Ministry of Commerce may permit direct import of ATF by or on behalf of Indian Carriers as actual users and on actual use basis.

Para 2.11 of Foreign Trade Policy, 2009-14 permits DGFT to grant an authorization to any other person to import or export any goods exclusively allowed by STEs. Therefore, import of ATF could also be permitted to Indian Carriers under Para 2.11 of Foreign Trade Policy, 2009-14.

Accordingly, such Indian Carriers who are interested to avail the opportunity to import ATF directly without going through STE route may apply to the DGFT. The prescribed format is ANF 2 B, which is available in the website of DGFT (dgft.gov.in).

Direct import of Aviation Turbine Fuel permitted for Indian carriers as actual users subject to authorisation and actual-use conditions. Indian carriers may be authorised to import Aviation Turbine Fuel directly as actual users and on an actual use basis, deviating from the State Trading Enterprise regime; such authorisation is available under the enabling provision of the Foreign Trade Policy and must be obtained by applying in the prescribed format ANF 2 B on the trade authority's website.
