CCI Uses Section 27 to Penalize Anti-Competitive Practices, Balancing Aggravating and Mitigating Factors for Fairness.
The Competition Commission of India (CCI), under the Competition Act, 2002, is authorized to impose penalties or issue cease and desist orders to address anti-competitive practices. When determining penalties under Section 27 of the Act, the CCI considers both aggravating and mitigating factors to ensure fairness. The primary objective of these penalties is to eliminate practices that negatively impact competition and to promote and sustain competitive markets, thereby protecting consumer interests. This information was provided by the Minister of Corporate Affairs in a written response to a question in the Lok Sabha.
